accepting these terms#
These terms are an agreement between you and Vibiz ("we", "us"), the maker of Fuku. By downloading or using Fuku, you agree to them and to our Privacy Policy. If you don't agree, please don't use Fuku.
age#
You must be at least 13 years old to use Fuku. If you are under the age of majority where you live, you may use Fuku only with the permission of a parent or legal guardian, who agrees to these terms on your behalf.
fuku is an AI#
Your friend in Fuku is an artificial intelligence, not a person. Its replies are generated automatically and may be inaccurate, incomplete or odd. Fuku is for entertainment and companionship. It is not professional, medical, legal, financial or crisis advice, and it is not a substitute for real people or real help. If you are in crisis, call or text 988 in the US, find a free line at findahelpline.com, or call your local emergency number.
acceptable use#
When you use Fuku, you agree not to:
- send or try to generate illegal content;
- send or try to generate any sexual content involving minors, ever;
- use Fuku to harass, threaten or harm anyone;
- try to get around message limits, safety systems or moderation;
- abuse, overload, reverse engineer or resell our API or service;
- access Fuku with bots, scripts or other automated means.
limits and enforcement#
To keep Fuku free and safe, we apply daily message limits and automated moderation. We may rate-limit, restrict or block a device that breaks these terms or puts the service or others at risk.
your content#
What you write stays yours. You give us permission to process your messages only as needed to generate replies and keep the service safe, as described in the Privacy Policy. Messages you choose to report are reviewed by us to improve safety.
provided as is#
Fuku is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. We don't guarantee that Fuku will always be available, uninterrupted or error-free, or that replies will be accurate. We may change or discontinue features at any time.
limitation of liability#
To the fullest extent permitted by law, Vibiz will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of, or reliance on, Fuku or its AI replies. Because Fuku is free, our total liability for any claim is limited to USD $50. Some places don't allow these limits, so they may not fully apply to you.
App Store#
Fuku is distributed through the App Store. Apple's Licensed Application End User License Agreement applies to your use of the app, alongside these terms. If they conflict, these terms apply to the extent permitted by that agreement. Apple is not responsible for Fuku or for supporting it.
governing law#
These terms are governed by the laws of [jurisdiction to be confirmed], without regard to conflict-of-law rules, except where the law of your country of residence gives you protections that can't be waived.
changes#
We may update these terms. When we do, we will change the date at the top, and for material changes we will note it in the app. Continuing to use Fuku after a change means you accept the updated terms.
